
Late in the afternoon, i received several texts from my pals about the decision of the Judge regarding the Subic Rape case. when i tuned in to the television, i watched the promulgation and three out of the four marines were acquitted. Lance Corporal Daniel Smith however was not as lucky. he was sentenced with reclusion perpetua or life imprisonment for the so called rape the women's group had alleged for almost a year. i personally think that this was their fight, not the victims'. she was merely as mascot for their vested interests. let me reiterate the fact that they are a bunch of hypocrites and are merely grandstanding. i point out again that when one of the Tulfo brothers approached them for help to 2 teenage girls who were raped, they said bluntly that they cant or should i say won't help them because their busy preparing for the Subic Rape case. the refusal to help the victims is itself a heinous crime. so i asked, who are the real criminals now? i thought this womens group are the vanguards of Filipina's rights against oppression and yet they did not help victims? i mean wow. they are a choosy bunch.
now, with regards to the verdict, i think it was both fair and flawed. fair because at least one of the accused was proven guilty beyond reasonable doubt to have taken advantage of Nicole's state of drunkenness. however, drunk people should be held responsible for their actions because for example, if someone is drunk and killed another person, he would go to jail for homicide. but when a woman gets drunk and do some stuff or fools around, it becomes rape? now thats something! temporary loss of sanity due to intoxication is not an excuse to pursue legal remedy for an alleged rape. hay.the things people do.
moving on, i think the judgment was flawed because i thought that the three were accessories, so they should have been sentenced as well, even for a minimum prison term. but i guess this wasn't so because if the prosecution pursued this detail, they would have lost and become the laughingstock. so all they did is to focus on daniel smith's conviction. plain and simple. lets say this was their consolation prize.
in addition, i was disgusted by the prosecution lawyer for shouting in the courtroom and i quote "this is the victory of the Filipino people and of the Filipino women".
i mean a lawyer should compose herself to be decent and respectable, not go about ranting and shouting what can be construed as militancy in action. i guess some people never change..and to think that these people who organize militant groups are schooled in our public universities using taxpayers money..or should i say the taxes i paid. so what if we ask them to repay us just a little bit of gratitude by thanking us? i can wait but i hope it will be soon. this is my personal take on the fiasco that just happened today.

well, i would have to agree with you.i think it was a compromise decision. sort of a " happy all" decision. one goes to jail, while the others are free. can be compared to a consolation prize.haha. thanks for your comment.
